Our responsibilities as intermediaries include:

  • Dispute resolution: In the event of a dispute, Trestiq steps in to mediate, using the evidence provided by both parties to reach a fair resolution. We aim to handle every case impartially and professionally, ensuring both buyers and sellers are treated fairly.

Trestiq specializes in the sale and purchase of a variety of digital assets. Below is an overview of the types of assets accepted on our platform:

  • YouTube Channels: Channels must be monetized, with a consistent income stream and a verified history of content creation. The channel must have an active audience and meet YouTube’s terms of service.
  • TikTok Accounts, Instagram Accounts, and Websites: These assets are coming soon to our platform. We are currently working on expanding the range of assets accepted on Trestiq, with plans to include social media accounts and websites soon.
  • Android Apps: Mobile apps developed for Android are also a part of our offering. Apps should have a stable user base and positive reviews. Trestiq will verify all apps before listing them.

Note: Trestiq does not facilitate the sale of securities, financial instruments, or any other non-digital assets. All listed assets must comply with the platform’s guidelines and be fully legal.

Trestiq Responsibilities

Although Trestiq facilitates transactions, we are not responsible for all aspects of the sale. Our responsibilities include:

  • Asset existence and validity: While Trestiq thoroughly checks the legitimacy of each asset before listing it on our platform, we cannot guarantee the future performance of these assets. Sellers are solely responsible for the accuracy and completeness of the information provided.
  • Provided information: We strive to maintain the accuracy of all listings. However, we encourage buyers to conduct their own due diligence and research before making their purchase. We recommend checking key metrics, reviews, and historical performance of assets listed on the platform.
  • Future performance: Trestiq does not make any guarantees regarding the future performance of any asset, including YouTube channels or apps. The value of digital assets may fluctuate due to a variety of factors, such as changes in market demand or algorithm updates on platforms like YouTube or TikTok.
  • User behavior: We are not responsible for the actions of buyers, sellers, or third parties during a transaction. However, we will take action against any violations of our platform’s terms of service, including attempts to bypass the platform or engage in fraudulent behavior.
  • Third-party services: If external services are provided along with the digital assets (e.g., third-party applications or marketing services), Trestiq does not guarantee their quality or suitability for the buyer’s needs.

Transaction Process

The following is a detailed overview of how transactions work on Trestiq:

Listing Assets

Sellers can list assets directly on Trestiq without needing to register. However, they must undergo a verification process to ensure the asset is legitimate.

For YouTube channels, sellers must add Trestiq as an administrator to their brand account to verify ownership and maintain control over the channel throughout the transaction process.

Escrow and Payment Processing

Trestiq holds funds in escrow during the transaction. The payment is only released to the seller once the buyer confirms receipt and satisfaction with the asset.

We accept various payment methods, including Bitcoin, Ethereum, PayPal, USD, USDT, and international bank transfers. All payment processing is handled securely through TrestiqPay, our internal payment system.

Refunds and Cancellations

Buyers can request a cancellation of the transaction before the transfer of ownership, with a 15% cancellation fee to cover operational costs. Once the transfer has been made, the transaction is final and cannot be reversed.

Dispute Resolution

Platform Availability Policy

Service Availability

Trestiq is committed to maintaining the platform operational and available to the best of its ability. However, due to the nature of technological services, service availability may be affected by external factors, unforeseen interruptions, or scheduled maintenance.

Scheduled Maintenance

In the event of scheduled maintenance or platform updates, Trestiq will notify users at least 48 hours in advance, whenever possible. During these periods, services may be temporarily unavailable.

Interruptions and Errors

Trestiq is not responsible for any interruption or error in the platform caused by technical issues beyond its reasonable control, such as failures from service providers, cyber-attacks, network failures, or other force majeure events.

No Liability for Platform Downtime

Trestiq will not be liable for any damage, loss, or injury arising from downtime or errors in the platform, nor for the inability to access it due to factors beyond the direct control of the company.

Intellectual Property Policy

Rights to Listed Assets

Users listing assets on Trestiq guarantee that they hold the property rights and legal rights to transfer such assets. Trestiq is not responsible for any intellectual property infringements arising from the content or assets sold, as these are solely the responsibility of the seller.

Use of Trademarks and Logos

Trestiq users may not use trademarks, logos, or any other visual content protected by intellectual property rights unless they have the express, written consent of the rights holders. Trestiq reserves the right to remove any content infringing intellectual property rights, including registered trademarks and copyrights.

Indemnity Clauses

Indemnification for Damages

Users agree to indemnify, defend, and hold harmless Trestiq, its employees, directors, agents, and affiliates from any claims, demands, losses, damages, or expenses (including legal fees) arising from the breach of this agreement or actions causing legal or financial harm to third parties. This includes, but is not limited to, intellectual property violations, illegal conduct, or breach of platform usage rules.

Responsibility in Case of Infringement

If a user uploads content that infringes upon third-party intellectual property rights or violates applicable laws, the user will bear full legal responsibility and the associated costs of such infringement.

Conduct Responsibility

Trestiq expects users to maintain respectful and professional conduct when using the platform. Any illegal, harassing, discriminatory, abusive, defamatory, or misleading conduct is prohibited. Additionally, fraudulent manipulation of platform services or any activity that damages the integrity of the system is prohibited.

Prohibition of Fake User Accounts

Trestiq does not allow the creation of fake, fraudulent, or fictitious user accounts. Any attempt to create a user account under a false name or using untruthful information will result in immediate account suspension and cancellation of related services.

Prohibited Conduct

Users are prohibited from:

  • Uploading illegal content or content that infringes upon third-party intellectual property rights.
  • Engaging in harassment or intimidation of other users.
  • Using the platform for fraudulent, misleading, or malicious purposes.

Disclaimer for User-Generated Content

User-Generated Content

Trestiq provides a platform for users to upload, share, and trade assets. However, Trestiq is not responsible for user-generated content or any damage or loss arising from it. The responsibility for content uploaded rests solely with the user who posted it.

Content Moderation

Trestiq reserves the right to review, moderate, and, if necessary, remove content that violates the platform’s terms of use. The company will take reasonable steps to ensure that assets and content comply with legal, intellectual property, and responsible use standards.

Corrective Action

If inappropriate content or content that violates platform policies is detected, Trestiq will take necessary corrective measures, including suspending the account or removing the content, without prejudice to any legal actions that may arise.

Asset Publishing on Trestiq

Free Publishing

The seller can publish their asset for free by paying a 15% commission on the total agreed price of the asset. This option is available to both sellers who choose a plan and those who do not.

Paid Advertising Plans

Sellers who choose any of the available plans (Basic, Platinum, or Corporate) will receive additional benefits in visibility and support for their ads, as detailed in the plan descriptions above.

Sales Commissions

Trestiq applies a standard commission of 15% on the sale of any asset, regardless of whether the seller has an active plan. However, exceptions apply for assets sold at certain thresholds:

  • Assets over $40,000: 10% commission
  • Assets over $60,000: 8% commission
  • Assets over $100,000: 6% commission
  • Assets over $200,000: Commission must be negotiated directly with Trestiq

Prohibition on External Platform Publishing

Sellers who publish their assets on external platforms outside of Trestiq will be violating the terms of service and will be blacklisted from Trestiq, prohibiting them from engaging in future transactions. Additionally, Trestiq must be the irrevocable administrator of the asset during the sales process. If the seller removes Trestiq as the administrator of the channel or asset, the listing will be hidden and lost permanently.

Trestiq Responsibility

Trestiq has the duty and obligation to ensure that all assets listed on the platform are 100% verified and that the details of each listing are truthful and accurate. In the case of any error or discrepancy related to asset verification, Trestiq will be solely responsible for resolving the matter.

Dispute Resolution

In the event of any dispute between the buyer and seller within the Trestiq platform, both parties must submit the dispute to a mediation process facilitated by Trestiq. The mediation aims to find a fair and equitable solution for both parties using a good faith conflict resolution process. If mediation does not lead to a satisfactory resolution within a reasonable time frame (e.g., 30 days), the parties involved may agree to submit the dispute to binding arbitration, according to the applicable laws and the relevant jurisdiction, following established legal procedures.

Prohibited Behavior

Trestiq is firmly committed to maintaining the integrity and proper use of its platform. Therefore, any conduct that could harm the reputation of Trestiq or its users is strictly prohibited. This includes, but is not limited to, fraudulent practices, abuse of the platform, the use of false information, or any behavior that contravenes the principles of good commercial faith. Users engaging in such actions will be permanently banned from the platform and will lose access to all offered services, with no possibility of account or asset restoration.

Force Majeure Disclaimer

Trestiq will not be held responsible for any breach of agreements or delays in the execution of its services resulting from circumstances beyond its reasonable control, such as natural disasters, strikes, payment platform failures, or interruptions in third-party services, among other unforeseen events. In case of force majeure, Trestiq is exempt from liability for any impact that may affect the execution of contracts or the fulfillment of its obligations within the platform. Affected parties should seek a solution in collaboration with Trestiq within the limits allowed by applicable legislation.

Cryptocurrency Usage Policy

Policy:
Transactions made using cryptocurrencies are subject to the inherent volatility of the market. Trestiq is not responsible for value fluctuations that may occur between the time of the transaction and the final transfer of funds.
The buyer must ensure that the transaction is completed correctly and at the agreed value.
Cryptocurrency payments must comply with local and international regulations governing cryptocurrency use.
Trestiq recommends users to utilize stable and proven cryptocurrencies and will manage payments securely while complying with all applicable laws.
In case of issues related to cryptocurrency payments or conversions, the buyer will be responsible for resolving any issues directly.

Inappropriate Content: Assets related to pornography, explicit violence, discrimination, or content that promotes hate, harassment, or abuse will not be allowed.
Reporting Process: Users can report any content they deem inappropriate or violative of these policies. Trestiq will review and take action within a reasonable time frame, including asset removal or user suspension.

Price Review Period: If an asset has not been sold within a reasonable time frame, the seller will be advised to review the price to improve its competitiveness on the platform.
Price Transparency: Asset prices must reflect a fair and reasonable value. Trestiq will work with the seller to determine price adjustments fairly, based on market analysis.

Buyer Responsibilities and Verification Process

1. Asset Details Verification

Trestiq ensures that all digital assets (e.g., YouTube channels, websites, and applications) are accurately described with key details, including monthly earnings, subscribers, price, niche, and creation date. However, these details may fluctuate by up to 20% higher or lower than the figures presented in the listing.

Example: A YouTube channel listed as generating $1,000 in monthly earnings may actually generate between $800 and $1,200. Buyers should understand and accept this margin when considering a purchase.

2. Trestiq’s Asset Verification Process

Once a buyer expresses interest, Trestiq will verify the details of the asset, confirming monthly earnings, subscriber count, and other relevant information before proceeding with the transaction. Once the asset’s details are confirmed, Trestiq will notify the buyer that the asset is ready for purchase.

3. Buyer Confirmation, Escrow Deposit, and Payment

Once Trestiq confirms the asset’s details, the buyer is required to:

  • Sign a formal contract outlining the sale terms.
  • Pay the full purchase price.
  • Deposit the full amount into Trestiq’s escrow account, ensuring the funds are secured until the transfer is completed and the buyer is satisfied.

The escrow deposit is essential to confirm the transaction. No asset transfer will occur until Trestiq secures the full payment.

4. Asset Transfer

Once the buyer’s payment is secured in escrow, the seller must grant the buyer access to the asset (e.g., adding the buyer as an administrator on the YouTube channel or website). The transfer must meet the legal and platform requirements for the asset in question.

5. Refund Policy

If the asset’s performance is more than 20% lower than the listed figures (e.g., earnings below $800 for a listing stating $1,000), the buyer may request a refund. Trestiq will review the claim and intervene if necessary to facilitate the refund process.

If the discrepancy is within the 20% margin, the transaction is final, and no refund will be issued.

6. Buyer Acknowledgment

By proceeding with a purchase, the buyer acknowledges the following:

  • Asset details (e.g., earnings, subscribers) may fluctuate within a 20% margin from the listing.
  • After confirming the asset’s details, the buyer agrees to deposit the full payment into escrow.
  • If the asset’s performance is below 20% of the stated earnings, the buyer is entitled to a refund.
  • Once the transfer begins, the buyer accepts the asset as per the verified details.

7. Offer Submission

If a buyer wishes to negotiate a lower price, they can submit an offer to Trestiq. Trestiq will forward the offer to the seller, and any response (acceptance, counteroffer, or rejection) will be communicated clearly. Once the price is agreed, the buyer will proceed with the payment and escrow deposit as outlined above.
